Support to the Construction Contracts Manager and to the Contract, Insurance and Legal Manager

  • Support the Construction Contracts Manager for the management of the EPC and workpackages contracts. Make the link with the Legal team of Luminus, and/or with other Legal Advisors, when legal support is needed.
  • Provide leadership and collaboration with the project management team and the Construction Contracts Manager on proactively identifying and mitigating risk at the project execution stage.
  • Support the Construction Contracts Manager in developing a procedure, in collaboration with the EPC and workpackages contractors, and publish on the exchange platform all the documents required for the monitoring of the contract (monthly, annual reports ... ),
  • Inform the Construction Contracts Manager and the Contract, Insurance and Legal Manager, immediately of any matters which are referred to the Disputes Resolution Procedure for the EPC Contract and the workpackage contracts (including at the formal amicable resolution stage foreseen in the different Project Documents), and assist in the preparation and, where appropriate, the presentation of any information required as a result,
  • Support the Construction Contracts Manager in anticipating and ensuring the management, coordination and follow-up of claims, contract variations and disputes resulting from the execution of the EPC and workpackage contracts,
  • Propose arbitration for contractual matters including variations to the Construction Contracts Manager and the Contract, Insurance and Legal Manager,

 

Support to the Project Team

  • Support the project Team in fostering a pro-active Health and Safety culture within the Project and with its subcontractors with an eye toward compliance with legal and contractual HSE requirements.
  • Attend site meetings together with the Construction Contracts Manager to monitor progress of technical issues to clearly define responsibilities and enable pragmatic resolution all in preserving the rights and entitlements of the Project.

Management of claims; change orders and communication of the EPC and workpackages contracts

  • Ensure notices are given in line with contract requirements and reply to notices from the contractors
  • Communicate in a diligent matter about all misinterpretation of the contract by the contractors to avoid claims to arise
  • Implement the formal claim management program on the project and to assess contract risks along with the Project Management Board. In particular ensure the traceability, the registration of instruction and the registration of negotiations.
  • Gather and analyse all justification materials necessary for the claim process (letters follow-up, event registration, documentation registration) with precise insights to give financial value to the claim and to elaborate a strategy of negotiation with a financial objective clearly identified
  • Ensure the collaboration of all Project team members and external stackholders necessary for the analysis of the situation subject to claim
  • Ensure that instruction for the resolution and negotiation of claims are clearly drafted and that the workflow is compliant with the process
  • Provide all necessary information and communication for the development and resolution of claims and disputes to/from suppliers, consortium partners and subcontractors.
  • Formalize the outcome of claim negotiation and formalize change orders together with the purchasing department
  • Prepare a preventive claim and conterclaim system with all justification materials together with the Construction Contracts Manager and the Project Team
  • Ensure the timely production of all contract documentation and their communication to the proper stakeholder in fulfillment of the Project obligations.
  • Maintain records for correspondence and documentation in relation to established contracts and those in progress.
  • Together with the Construction Contracts Manager, ensure the necessary meetings are planned and organized necessary for the proper execution of the contracts and the associated minutes are drafted,
  • Ensure compliance in approval of variation orders, amendments and settlements in accordance with the applicable delegation of authority.

Compétences

  • Strong communication, cooperation and negotiation skills to influence and negociate in English and French.
  • Strong understanding of contract agreements and associated contractual risks.
  • Solid understanding of legal, financial and contractual terminology
  • Structured and rigourous approach of contract management with strong attention to details.
  • Technical skills regarding engineering, construction, commissioning and operation of technical projects
  • Capable of professionally managing confidential information

Previous experience in contract management claim management in the field multidisciplinary fields
